Description:

Memorandum for the Government from the Office of the Minister for Justice regarding the Administration of Estates and Wills. Contains a submission by the Minister of a general scheme of a Bill to provide for the amendment and consolidation of the law relating to the devolution and administration of property on death ; the distribution of property on intestacy; wills and the legal rights of the surviving spouses and children of the deceased person. In reference to spouses, the Minister proposes that the Acts relating to wills should be repealed and replaced by modern legislative code incorporating a system of family provision which will prevent a testator from disinheriting or making insufficient provision for his dependants. 'The special position of the family as a moral institution forming the necessary basis of social order, as recognised in the Constitution, demands that a man's obligations to maintain his wife and children during his life should extend also ... to their maintenance after [his] death.' Detailed consideration of this is contained in remainder of memorandum.
