Memorandum on the proposed amendment of the Midwives (Ireland) Act, 1918 issued by the Department of Local Government and Health, 8 November 1929. The memorandum deals with the need to amend Section 1 (2) of the Act which provides that `no woman shall habitually and for gain attend women in childbirth otherwise than under the direction of a registered medical practitioner. The memorandum states that it has been found difficult to get the necessary evidence to prove that `attendance by unregistered persons "is habitually and for gain"'. `It is therefore desired to amend this Section to provide that if any person not a certified midwife attends a woman in child birth it shall be necessary to satisfy the Court that the attention was given in a case of sudden and urgent necessity - this of course would not apply to a person in course of training to become a doctor or a midwife'. The memorandum also discussed other proposed amendments. `It is therefore desired to amend Section 5 to frame a rule as to the wearing of badges by certified midwives and to amend Section 9 - which provides for the return by a midwife of her certificates when her name is removed from the roll …' |
