Description:

Memorandum on the proposed amendment of the Midwives (Ireland) Act, 1918 issued by the Department of Local Government and Health, 8 November 1929. The memorandum deals with the need to amend Section 1 (2) of the Act which provides that `no woman shall habitually and for gain attend women in childbirth otherwise than under the direction of a registered medical practitioner. The memorandum states that it has been found difficult to get the necessary evidence to prove that `attendance by unregistered persons "is habitually and for gain"'. `It is therefore desired to amend this Section to provide that if any person not a certified midwife attends a woman in child birth it shall be necessary to satisfy the Court that the attention was given in a case of sudden and urgent necessity - this of course would not apply to a person in course of training to become a doctor or a midwife'. The memorandum also discussed other proposed amendments. `It is therefore desired to amend Section 5 to frame a rule as to the wearing of badges by certified midwives and to amend Section 9 - which provides for the return by a midwife of her certificates when her name is removed from the roll …'

Extract from a memorandum issued to the Constitution Committee by the President's Department, 13 March 1926. With regard to Article 3 of the constitution [which defines a citizen of the Irish Free State, a definition which is without distinction of sex] the `question has been raised as to whether this Article prevents the Civil Service Commissioners from holding examinations limited to one particular sex. This contention would give an extraordinary wide meaning to the expression "privileges of citizenship" and in any event, it is understood that it is not supported by the Attorney General'.
